These Terms of Use (the "Terms") form a legal agreement between you and asdasdaors Trader. Using the Services means you accept these Terms and our Privacy Policy. They cover important information such as updates, liability limits, a class action waiver, and agreement to arbitration.
Important: If you do not agree with these Terms, do not use the Services.
Arbitration & Class Action: Except as noted below, disputes will be settled by binding individual arbitration, and you waive your right to class actions or class-wide arbitration.
Connecting Vehicle Sellers and Auction Bidders
asdasdaors Trader acts as the link between car sellers and buyers. The sales contract for each vehicle is directly between asdasdaors Trader and the winning bidder. "You" means any user, whether seller or bidder, registered or not. We facilitate connections and expect sellers to provide accurate, current information and to reasonably follow through on sales when a winning bid is received. Bidders agree that winning a bid is binding and payment is required. User personal data is protected by applicable privacy laws; our Privacy Policy does not cover third-party practices.
Updates to These Terms
We may update these Terms at any time. When changes occur, we may notify you via the website, email, or other means. If you disagree with the updates, you may decline them, but then you will not be able to use the Services. Continued use after changes means you accept the new Terms. Only written and signed agreements by both parties can override these Terms.
Your Privacy Matters
Protecting your privacy is a top priority, as outlined in our Privacy Policy. We comply with COPPA and do not knowingly collect personal information from children under 13. If you are under 13, do not register, use our Services, or provide personal data. If we discover information from a child under 13, we will delete it. If you believe a child under 13 has shared personal info, contact james.nowlin@hotmusclecars.com.
Getting Started with asdasdaors Trader
To use the Services, you must create an account with a username and password ("User ID") and provide accurate, complete, and current information. Do not use a User ID you do not own, impersonate others, or transfer your account without our written consent. By accepting these Terms, you confirm you can enter into a contract (or have parental/guardian permission). If representing an organization, you must have authority to bind it. Use the Services only for lawful purposes. Keep your User ID and password secure and do not share them; you are responsible for all actions on your account.
Communication and Messaging
As part of the Services, you may receive messages from asdasdaors Trader, including emails. When you sign up, we may send a welcome message with details on how to opt out of certain marketing communications.
Usage Restrictions
You agree not to use the Services to post content or act in ways that: (a) violate others' intellectual property or rights (including asdasdaors Trader); (b) break laws or regulations; (c) harm, deceive, threaten, harass, defame, or manipulate the bidding system; (d) compromise account or network security; (e) attempt to access others' accounts or passwords; (f) bypass protections; (g) send spam or disrupt the Services; or (h) scrape, copy, reverse engineer, or extract code or data. Violations may lead to termination. You may only collect user info necessary for the auction and must delete it afterward, in compliance with law.
Your Rights and Content Use
All content on the Services is protected by copyright and intellectual property laws. You agree to respect all copyright and trademark rules. Subject to these Terms, asdasdaors Trader grants you a limited, worldwide, non-exclusive license to use content solely to access and use the Services. asdasdaors Trader owns the Services and content; any other use requires prior written consent.
Guidelines for User Submissions
User Submissions are content you post, upload, or share through the Services and may be visible to others. You are responsible for ensuring submissions are accurate, complete, current, lawful, and do not include prohibited content such as infringement, sexual content, hate, exploitation of minors, illegal acts or extreme violence, animal cruelty, scams or unlawful activity.
User Submission Licenses
By sharing User Submissions on our platform, you grant asdasdaors Trader a worldwide, non-exclusive, perpetual, royalty-free license to use, modify, reproduce, distribute, display, and create derivative works of your submissions in connection with our Services and business, including promotion through any media or third-party channels. This license survives account closure. You also grant other users a license to access and use your submissions. You retain ownership and confirm you have the rights to grant these licenses. asdasdaors Trader may make technical modifications for compatibility.
Reporting Copyright Infringement (DMCA)
We may block or remove content that appears to infringe copyrights. Repeat offenders risk losing access.
To report infringement, send a notice to our designated agent at asdasdaors Trader including: your signature; identification of the copyrighted work; identification and location of the infringing material; your contact information; a good-faith statement that use is unauthorized; and a sworn statement that your notice is accurate and you are authorized to act. Address: Designated Agent, asdasdaors Trader, Boise Plaza, 1111 W Jefferson St, Boise, ID 83702.
Counter-Notice: If you believe removal was mistaken or authorized, send a counter-notice with your signature; identification and original location of the removed content; a good-faith statement of mistake; contact information and consent to the jurisdiction of Federal Court in your district (or where asdasdaors Trader is located if outside the U.S.); and agreement to accept service of process from the notifier. We may reinstate material within 10–14 business days unless legal action is taken.
Responsibility for Content and Interactions
Content posted or shared on the Services is the sole responsibility of the user who provided it. You access such content at your own risk, and asdasdaors Trader is not liable for errors, omissions, damages, or losses related to it. The Services may link to third-party sites or services, which we do not own or control. We are not responsible for their content, accuracy, policies, or practices. Use them at your own risk and review their terms and privacy policies.
We do not intervene in disputes between users or with third parties. By using the Services, you release asdasdaors Trader and its affiliates from all claims or damages arising from such disputes, as allowed by law.
Changes to the Services
We continually improve our Services, which may result in changes over time. We may modify, limit, suspend, or terminate features, or restrict access to parts or all of the Services, at our discretion. Content may be removed without notice if we believe it violates these Terms.
Service Fees
Registration is free, but certain features may require payment. By using paid features, you agree to our Fees Terms, which may change over time. We may introduce fees for additional Services in the future and will provide advance notice before applying them to Services you already use. If you win a car auction, you must pay the winning bid amount after the auction ends. All buyer payments are fully refundable.
Seller Payments
Sellers must provide asdasdaors Trader with all required payment details, including bank account information and a current IRS Form W-9, within 90 days of an auction's end. Failure to do so releases asdasdaors Trader from any payment obligations, and the Seller waives the right to receive those funds.
Stopping Use of the Services
You may close your account at any time by contacting james.nowlin@hotmusclecars.com. See our Privacy Policy and the license terms above for how we handle your information after you stop using the Services.
asdasdaors Trader may suspend or terminate your account or access to the Services at its sole discretion, for any reason, including violations of these Terms. Only asdasdaors Trader may determine whether a violation has occurred. If your account is terminated, associated content may be permanently deleted. Certain provisions survive termination, including payment obligations, indemnification, limitations of liability, intellectual property ownership, and dispute resolution (including arbitration).
Disclaimer of Warranties
asdasdaors Trader and its affiliates, licensors, suppliers, partners, and their respective officers, directors, members, employees, contractors, representatives, and agents make no guarantees regarding the Services or any content accessed through them. All products or services obtained through the Services, including seller cars, are provided "AS IS" without warranties of any kind, whether express or implied.
Limitation of Liability
To the fullest extent permitted by law, asdasdaors Trader and related parties shall not be liable under any legal theory for: (A) indirect, incidental, special, punitive, or consequential damages; (B) substitute goods, services, or technology; (C) amounts exceeding the greater of 100 USD or the total paid by you to asdasdaors Trader in the preceding 12 months; or (D) matters beyond our reasonable control. Some jurisdictions may not allow these exclusions.
Indemnification
You agree to indemnify and hold harmless asdasdaors Trader and related parties from all claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, any third-party use of your account, or your violation of these Terms.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer them without restriction.
Governing Law
These Terms are governed by the Federal Arbitration Act, applicable federal law, and the laws of the applicable U.S. state, without regard to conflict-of-law principles.
Arbitration Agreement
You and asdasdaors Trader agree to resolve disputes arising under these Terms through binding arbitration under the JAMS Streamlined Arbitration Rules in English, before an experienced arbitrator. Arbitration fees for claims under 100,000 USD will be paid by asdasdaors Trader. Either party may bring qualifying claims in small claims court. Parties may seek injunctive relief in court for intellectual property disputes. By agreeing to these Terms, you waive any right to a jury trial or class action. If the class action waiver is unenforceable, disputes will be resolved in court. You may opt out of arbitration within 30 days of accepting these Terms by providing written notice with your account information.
Taxes
You are responsible for all taxes and governmental charges related to your activities on the Services unless we choose to handle them.
General
Failure to enforce any right does not waive it. If any provision is invalid, it will be limited or removed as necessary, and the remainder will remain in effect. These Terms are the entire agreement between you and asdasdaors Trader, superseding prior agreements. You are not our employee, agent, partner, or joint venturer, and have no authority to bind us. Except for the Arbitration Agreement, no third-party beneficiaries are intended.
